TERMS OF SERVICE

1. ABOUT THESE TERMS

These Terms of Service govern your access to and use of the website and online store available at www.sportstakeoff.com, as well as purchases made through the store.

The store is operated under the trading name Sports Takeoff by:

In these Terms, “Sports Takeoff,” “we,” “us” and “our” refer to Deante N Battle Consulting.

By using the website or placing an order, you agree to these Terms and the policies incorporated into them. Nothing in these Terms limits any mandatory rights available to consumers under Polish or European Union law.

2. STORE PLATFORM

Our online store is hosted by Shopify, which provides the e-commerce platform through which products and services are offered.

Certain store functions, including payment processing, currency conversion, fraud prevention, analytics and delivery services, may be provided by third parties subject to their applicable terms and privacy practices.

3. ELIGIBILITY AND ACCOUNTS

You must have the legal capacity to enter into a purchase contract. If you are under the applicable age of majority, you may use the store only with the involvement and consent of a parent or legal guardian.

If you create an account, you are responsible for keeping your login details confidential and for activity conducted through your account. Information supplied during registration or checkout must be accurate, current and complete.

Please notify us promptly if you believe your account has been used without authorization.

4. PRODUCTS AND PRODUCT INFORMATION

Sports Takeoff sells American football equipment, footwear, apparel and accessories.

We make reasonable efforts to provide accurate product descriptions, specifications, sizing information, photographs and availability information. However:

• Screen settings may affect how product colours appear.
• Manufacturer measurements and sizing may differ between brands and models.
• Packaging, minor design details or manufacturer specifications may change.
• Product photographs may contain display items or accessories not included with the purchased product.

Customers should review the complete product description, selected size, colour, model and compatibility information before ordering.

Product descriptions may be corrected or updated when an error or manufacturer change is identified.

5. AMERICAN FOOTBALL EQUIPMENT AND SAFETY

American football is a contact sport involving an inherent risk of injury. No helmet, shoulder pad, mouthguard, protective garment or other item can eliminate every risk of injury.

Customers must:

• Select the correct size and model.
• Follow manufacturer fitting, use, inspection and maintenance instructions.
• Check compatibility between helmets, facemasks, chinstraps, visors and related accessories.
• Replace damaged, altered, expired or improperly fitting equipment.
• Consult a qualified coach, equipment manager or manufacturer when fitting or compatibility is uncertain.

Protective equipment must not be modified except as expressly permitted by its manufacturer.

Nothing in this section excludes liability that cannot legally be excluded, including applicable product-liability or consumer-protection rights.

6. PRICES, TAXES AND CURRENCIES

Prices are displayed in the currency associated with the customer’s selected country or market.

The final product price, applicable taxes, discounts and delivery charges will be displayed before the customer submits the order.

For deliveries outside the European Union, additional import VAT, customs duties, brokerage fees or other charges may be imposed by the destination country. Unless expressly collected during checkout, these charges are the customer’s responsibility and are not controlled by Sports Takeoff.

Prices may change without prior notice. A price change will not affect an order that we have already accepted, except where the displayed price was an obvious error that a reasonable customer should have recognized.

7. PLACING AN ORDER

By selecting the final checkout button, you submit an offer to purchase the products in your order and agree to pay the displayed total.

An automated message acknowledging receipt of an order does not necessarily mean that the order has been accepted. A purchase contract is formed when we send confirmation that the order has been accepted or dispatched, whichever occurs first.

We may refuse or cancel an order before acceptance for legitimate reasons, including:

• The product is unavailable.
• Payment was not authorized.
• The order information is incomplete or materially incorrect.
• An obvious pricing or product-information error occurred.
• Fraud, unauthorized resale or unlawful activity is reasonably suspected.
• Delivery to the supplied address is unavailable.
• A legal or regulatory restriction prevents the sale.

If payment has already been collected for an order we cannot accept, the relevant amount will be refunded.

8. PAYMENT

Available payment methods are displayed during checkout. Payments may be processed by Shopify Payments or another third-party payment provider.

The customer confirms that they are authorized to use the payment method submitted with the order.

We may conduct reasonable payment and fraud-prevention checks. An order may be delayed or cancelled when additional verification is reasonably required or payment cannot be authorized.

9. PROCESSING AND DELIVERY

Order processing periods, available delivery methods, charges and estimated delivery times are described in our Shipping Policy and during checkout.

Delivery dates are estimates unless we expressly confirm a guaranteed delivery service. Carrier delays, customs processing, severe weather, public holidays, strikes, border controls and other events outside our reasonable control may affect delivery.

A late carrier delivery does not automatically entitle the customer to a refund of delivery charges. However, this does not restrict any mandatory remedy available where an order is not delivered within an expressly agreed period or within the period required by applicable consumer law.

Customers must provide an accurate and complete delivery address. Additional costs caused by an incorrect or incomplete address, an uncollected parcel or an unjustified refusal of delivery may be charged to the customer where permitted by law.

For consumer orders, risk of loss or damage generally passes to the customer when the customer or a nominated recipient physically receives the goods, except where applicable law provides otherwise.

10. RIGHT OF WITHDRAWAL

Consumers purchasing at a distance generally have the right to withdraw from the purchase contract within 14 days without providing a reason, subject to applicable legal exceptions.

The withdrawal period normally begins on the day after the consumer, or a person nominated by the consumer, receives the goods.

To exercise this right, the consumer must send a clear withdrawal statement to:

The right of withdrawal may not apply to certain products permitted by law, including:

• Goods made to the customer’s specifications or clearly personalized.
• Sealed goods that are unsuitable for return for genuine health or hygiene reasons after the seal has been broken.
• Other goods covered by a statutory exception.

Any exception will be applied only where legally applicable.

Unless otherwise stated, the consumer bears the direct cost of returning goods following a standard withdrawal. The cost of returning defective, incorrect or non-conforming goods is handled under the applicable complaint and legal-guarantee rules.

11. REFUNDS FOLLOWING WITHDRAWAL

When a valid withdrawal is exercised, we will refund payments required by law, including the cost of the least expensive standard delivery method offered for the order.

Additional costs resulting from the customer choosing an enhanced or express delivery method are not required to be refunded beyond the cost of standard delivery.

A refund will normally be made using the original payment method. We may withhold the refund until we receive the returned goods or the customer supplies evidence that the goods were sent back, whichever occurs first, where permitted by law.

The customer may be responsible for a reduction in value caused by handling beyond what is reasonably necessary to inspect the nature, characteristics and functioning of the product.

12. DEFECTIVE OR NON-CONFORMING PRODUCTS

Consumers have mandatory legal rights when goods are defective, damaged, incorrect or do not conform to the purchase contract.

Depending on the circumstances and applicable law, remedies may include repair, replacement, a price reduction or termination of the contract.

Customers should contact dbattle@sportstakeoff.com with:

• The order number.
• A description of the problem.
• Photographs or other supporting information where reasonably available.

Submitting photographs may help us evaluate a claim more quickly, but it does not remove any mandatory consumer right.

Commercial manufacturer warranties, where offered, apply independently of the customer’s statutory rights.

13. RETURNS ADDRESS

The registered business address at Nowy Świat is not a warehouse or returns facility.

Products must not be returned to the registered address. Customers must contact us and wait for return authorization and the correct return instructions.

Goods sent to an unauthorized address may be delayed, rejected or returned to the sender. This does not prevent a customer from exercising mandatory consumer rights through a valid withdrawal or complaint submitted within the applicable period.

14. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes are subject to their stated conditions, validity periods and product restrictions.

Unless expressly stated otherwise:

• Discount codes cannot be exchanged for cash.
• Codes cannot be combined.
• Discounts cannot be applied retrospectively.
• Promotions are subject to product availability.
• A discount may be cancelled if it was obtained or used through fraud, technical abuse or a clear pricing error.

Mandatory consumer rights remain unaffected.

15. INTELLECTUAL PROPERTY

The website and its original content—including text, graphics, logos, page layouts, photographs and product descriptions—are owned by or licensed to Sports Takeoff and are protected by applicable intellectual-property laws.

Website content may not be copied, reproduced, republished, distributed, scraped or commercially exploited without prior written authorization, except where permitted by law.

Third-party product names, trademarks and logos remain the property of their respective owners. Their appearance on the website identifies products offered for sale and does not imply ownership or sponsorship by Sports Takeoff.

16. CUSTOMER REVIEWS AND SUBMISSIONS

If you submit a review, photograph, comment or other content, you confirm that:

• You have the right to submit it.
• It is accurate to the best of your knowledge.
• It does not infringe another person’s rights.
• It is not unlawful, defamatory, threatening, discriminatory, obscene, fraudulent or misleading.
• It does not contain malware or unauthorized advertising.

You grant Sports Takeoff a non-exclusive, worldwide, royalty-free licence to display and use submitted content in connection with operating and promoting the store, subject to applicable privacy and consumer law.

We may moderate or remove content that violates these Terms or applicable law.

17. PROHIBITED USES

You must not use the website:

• For an unlawful or fraudulent purpose.
• To infringe intellectual-property or privacy rights.
• To transmit malicious software.
• To interfere with website security or operation.
• To scrape, harvest or collect information through unauthorized automated methods.
• To impersonate another person.
• To submit false payment, account or delivery information.
• To abuse promotions, discounts, returns or payment disputes.

We may restrict access or cancel affected orders where reasonably necessary, subject to applicable law.

18. THIRD-PARTY SERVICES AND LINKS

The website may include links to third-party websites or services. We do not control third-party content or services and are not responsible for them except where liability arises under mandatory law.

Customers should review the applicable terms and privacy practices before using a third-party service.

19. WEBSITE AVAILABILITY

We do not guarantee that the website will always be uninterrupted or error-free. Access may be temporarily suspended for maintenance, security, updates or circumstances outside our reasonable control.

We may change or discontinue website features, provided this does not affect contracts already concluded or mandatory customer rights.

20. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, applicable product liability, or mandatory consumer rights.

To the extent permitted by law, Sports Takeoff is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the purchase contract was formed.

For customers purchasing primarily for business purposes, our aggregate contractual liability will be limited to the amount paid for the affected order, except where applicable law prohibits such a limitation.

21. EVENTS OUTSIDE OUR CONTROL

We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, war, civil disturbance, governmental measures, border restrictions, carrier disruption, strikes, major network failures or failures of essential third-party services.

We will take reasonable steps to reduce the effect of such events and will notify affected customers where appropriate. Mandatory rights concerning undelivered orders remain unaffected.

22. PRIVACY AND COOKIES

Our collection and use of personal information are governed by our Privacy Policy and applicable cookie settings.

The Privacy Policy explains how information may be processed by Shopify, payment providers, analytics services, advertising platforms, couriers and other authorized providers.

23. GOVERNING LAW AND CONSUMER JURISDICTION

These Terms and purchase contracts are governed by the laws of Poland.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory protections available under the law of your country of habitual residence.

Consumers may bring proceedings before any court having jurisdiction under applicable consumer law. Nothing in these Terms requires an EU consumer to bring a claim exclusively before a Polish court where such a restriction would be unlawful.

For transactions between businesses, disputes will be submitted to the court having jurisdiction over the registered office of Deante N Battle Consulting, unless mandatory law provides otherwise.

24. COMPLAINTS AND OUT-OF-COURT RESOLUTION

Please send complaints to dbattle@sportstakeoff.com and include the relevant order number and a description of the issue.

Consumers may also seek assistance from an appropriate consumer ombudsman, consumer organization, Trade Inspection authority or another authorized alternative dispute-resolution entity.

The former European Commission Online Dispute Resolution platform was discontinued on July 20, 2025 and is therefore not linked in these Terms.

25. CHANGES TO THESE TERMS

We may update these Terms when business operations, services or legal requirements change.

Changes will apply from the date the updated Terms are published. Unless required by law, changes will not retrospectively alter a purchase contract already concluded. The version in effect when an order is placed will generally govern that order.

26. SEVERABILITY

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be interpreted or replaced to the minimum extent required to make it lawful and enforceable.

27. ENTIRE AGREEMENT

These Terms, together with the policies and information referenced during checkout, form the agreement governing use of the store and purchases made through it.

If these Terms conflict with a mandatory consumer right, the mandatory right will apply.
